3. Counter-Notice Procedure

If you believe that material you posted was removed or access to it was disabled by mistake or misidentification, you may file a counter-notice with our Designated Agent. To be effective under 17 U.S.C. §512(g)(3), your counter-notice must include all of the following elements:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Yealo may be found.
  • A statement that you will accept service of process from the person who provided the original takedown notification, or an agent of such person.

Send your counter-notice to our Designated Agent at the contact information listed in Section 1 above, or by email to legal@yealo.us. Upon receipt of a valid counter-notice, we will restore the removed material within 10 to 14 business days unless the original complainant files a court action seeking to restrain the alleged infringement.

4. Repeat Infringer Policy

In accordance with 17 U.S.C. §512(i), Yealo has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. Users who repeatedly upload content that infringes the copyrights of others will be terminated from the Service.

Yealo reserves the right to remove or disable access to content that is alleged to be infringing, and to terminate the accounts of repeat infringers, at its sole discretion and without prior notice.
